The Workplace Relations Commission found Dara Purcell's complaint over performance-related pay against the Health Service Executive was not well founded. Adjudication Officer Michael McEntee dated the decision 8 March 2024.

Purcell argued that his 2006 contract allowed performance-related pay of up to 20%. He said a 10% salary uplift had replaced that payment, but the HSE removed the uplift in 2017 or 2018 without restoring the performance-related pay. He stated that his annual salary was €132,000.

The HSE said legislation and related measures governed public service pay and that it had to follow them. The WRC found that the pay adjustments could be traced to legislation and circulars, and rejected the complaint under the Payment of Wages Act. The adjudicator said the contract interpretation issue was a matter for a higher court.
