WRC rules it had no jurisdiction over Kelvin Gopaul’s wage complaint

The Workplace Relations Commission had no jurisdiction to hear Kelvin Gopaul’s complaint against Fallon And Byrne over alleged unpaid wages, so the underpayment claim was not decided on its merits. Gopaul said he had not received his full pay entitlements during 2020 and that the respondent’s failure to deduct PAYE, USC and PRSI meant he was taxed on his net pay. The respondent argued the complaint was referred more than two years after he left the job. A WRC adjudication officer found the complaint was referred more than 12 months after the alleged breaches. The decision was dated 22 November 2023.
