The Workplace Relations Commission rejected Emmett Doyle’s complaint that Theo Benning Ireland Gmbh unlawfully reduced his pay when it cut his working hours. The decision, dated 25 November 2024, found that an established custom and practice formed part of the employment contract and authorised the reductions. Doyle argued his contract guaranteed 40 hours a week and did not allow unpaid reductions. The company said reduced hours and pro-rata pay during quieter periods reflected a long-standing practice. The officer found a wage deduction had occurred but ruled it was not unlawful under the implied contractual term.
