WRC finds Martin O’Neill’s constructive-dismissal complaint not well founded

The Workplace Relations Commission found Martin O’Neill’s unfair-dismissal complaint against Afm Facilities Ltd Afm Ireland / Ashbrooke Facilities Management not well founded in a decision dated 21 August 2023. O’Neill said changes to sales commission arrangements and the removal of an account contributed to his resignation. The company said its commission structure had not changed and that the account was an existing client assigned to operations. The adjudication officer found O’Neill had not formally used the company’s grievance procedure. The officer said substantial use of available internal procedures was an essential element of a constructive-dismissal claim.
