The Workplace Relations Commission found Gary Maloney’s dismissal unfair and directed his employer, Griffin Autos Ltd Bill Griffin Motors, to pay him €12,500 for financial loss. The decision was dated 9 January 2024.
Maloney, a sales representative, said he believed a week of annual leave had been accepted and was sent home when he returned, without a disciplinary meeting or later contact. The company said the leave had been refused and that he resigned. The adjudication officer accepted Maloney was told to leave and found the employer had shown no investigation or disciplinary process.
The officer took account of Maloney’s efforts to limit his losses and his contribution to his dismissal when setting the €12,500 award. His other complaints, including claims under employment, pay and working time laws, were withdrawn.
