The Workplace Relations Commission (WRC) has awarded Brendan Moran €46,876 after finding his complaints against Emex Software Limited for unpaid wages and notice pay well founded. The decision was dated 31 August 2023.

Moran said he joined the company as VP Finance in November 2022 on a salary of €10,417 a month. He told the WRC he received only half his October pay and no pay for November, December or January. He sought €36,459 in unpaid salary and €10,417 in lieu of notice, as well as expenses, pension contributions and commission.

The respondent did not attend the hearing or provide written evidence. The adjudicator accepted Moran’s uncontested evidence about pay and notice. The Payment of Wages Act excludes expenses and pension payments, and the adjudicator could not determine whether bonus targets had been met.
