WRC declines to extend deadline for complaints against g Hotel operator

The Workplace Relations Commission refused to extend the deadline for Eduard Biryukov’s complaints against Niche Hotels UC, which runs the g Hotel, and said it had no jurisdiction to adjudicate them. The decision was dated 13 September 2023. Biryukov, a kitchen porter, had presented an unfair-dismissal complaint, a complaint about notice and a discrimination complaint on the ground of hearing loss. At the hearing, he said his Payment of Wages Act complaint was intended as an unfair-dismissal complaint. The officer found the complaints were submitted after the time limit and that he had not shown reasonable cause for an extension, so the merits were not decided. A duplicate minimum-notice complaint was withdrawn.
