The Workplace Relations Commission found that Wwetb did not discriminate against Thomas Kearney on the disability ground after he was not shortlisted for a teaching post. The decision, dated 3 November 2023, concerned recruitment by an Education and Training Board.
Kearney said he had the experience for the Instructor Carpentry & Joinery post and believed he was overlooked because he had disclosed a disability. The board said he did not meet its requirement for five years of relevant post-qualification experience. The adjudicator found Kearney had not established a prima facie case of discrimination, including because he provided no comparator, and accepted that lack of experience explained why he was not shortlisted.
