The Workplace Relations Commission found three unfair dismissal complaints by Artur Calun against Hermitage Clinic Unlimited Company not well founded. Calun had worked as a catering assistant from 2006 until his dismissal in September 2022. The decision was dated 3 November 2023.

The clinic said it dismissed Calun for theft after CCTV and witness accounts indicated he had removed items from its premises on 14 occasions. Calun said he took leftover food to a former colleague with his supervisor’s knowledge. The adjudicator accepted the manager’s evidence that Calun had no permission, found the investigation and dismissal process fair, and concluded the dismissal was within the range of reasonable responses. The three complaints were considered together as an unfair dismissal case.
