WRC rejects former Alcon worker’s wage complaint on time limit

The Workplace Relations Commission found it had no jurisdiction to hear John Paul O' Brien’s Payment of Wages complaint against former employer Alcon Laboratories Ireland Ltd. The decision was dated 18 December 2023. The merits were not decided. O' Brien claimed he was short-paid for work in February 2021 after his pay moved from arrears to current. Alcon denied the claim and argued it was outside the statutory time limit. The adjudication officer found the alleged contravention was outside the period the WRC could consider, and concluded the complaint was not well-founded on that basis.
