The Workplace Relations Commission directed Lmetb to pay former employee Yvonne O'Byrne Kearns €2,858.89 for failing to provide written employment terms on time and €1,930.86 for unlawful wage deductions. The decision, dated 23 November 2023, found her contract entitled her to the qualified-teacher pay rate.
Kearns said the contract she received after her employment ended described her as a qualified teacher and provided for teachers’ pay, but she had been paid the lower tutor rate. Lmetb argued the advertised role was a tutor post and that it had paid the correct rate under a Department circular. The WRC found the final contract set out the applicable terms and that the qualified-teacher rate was properly payable. It also found that the late contract caused stress and inconvenience.
A related complaint under road-transport working-time regulations was found not well founded because those regulations did not apply to the case.
