The Workplace Relations Commission awarded Spela Pintar €48,000 after finding she was unfairly dismissed by Suirsafe Technologies Ltd. In a decision dated 10 January 2024, it also ordered the company to pay her unpaid wages and compensation for accrued annual leave.
Pintar said she resigned on 7 October 2022 after going without pay for more than three months. The company did not attend the hearings or provide submissions. The WRC found it was reasonable for her to leave after her wages went unpaid, and that she had made significant efforts to find new work before starting another job in September 2023.
The WRC also ordered €13,351.50 for wages due from July to September 2022, €1,027.04 for her final week of work, and €3,163 for about 3.08 weeks of accrued leave, with a further €3,000 compensation. It found she was not entitled to the two months’ severance pay she claimed. The WRC did not allow payment for annual leave claimed while she was still employed.
