The Workplace Relations Commission found two complaints by Brian Dumigan against Jadehall Limited (In Receivership) t/a Murray's Super-Valu were not well founded. The decision was dated 6 September 2023. Dumigan, a butcher who said he had been promoted to head butcher, claimed he was owed a 10% union rate increase and that his employer breached his terms by refusing to negotiate pay with him or his representative. The adjudicator found the increase was not properly payable under the Payment of Wages Act, noting evidence suggested Dumigan had a separate pay arrangement. The alleged failure to negotiate was not an actionable complaint under the Terms of Employment (Information) Act.
