The Workplace Relations Commission allowed Gerard Farrell’s appeal for statutory redundancy after his employer, Maherus Ltd, went into liquidation. In a decision dated 18 September 2023, the WRC found his complaint well founded, subject to confirmation that his employment was insurable for redundancy purposes. Farrell worked as a sales assistant from 4 February 2012 until the business closed on 16 March 2022. He told the WRC he had not received redundancy pay. The company said it had been liquidated and had not traded since January 2022. The decision sets out an entitlement of two weeks’ pay for each year or part year of reckonable service, plus one week, based on a gross weekly wage of €350. It says the appropriate government agency must confirm eligibility and that reckonable service excludes periods of lay-off.
