The Workplace Relations Commission ordered the respondent to pay Andrew Stanley €10,833 and four weeks’ net pay in compensation after finding an unlawful deduction of wages. The decision was dated 13 October 2023. Stanley said he was owed one month’s salary and commission after leaving Bark & Birch on 31 December 2021. The respondent, named in the WRC header as Nick Rijniers/bark & Birch, did not attend the hearing. The adjudication officer accepted Stanley’s explanation for making his claim outside the usual six-month period but within 12 months, finding reasonable cause because he had been engaging with the company and the WRC during the six-month period. She found his account credible and uncontested, and ruled that the unpaid commission counted as wages under the Payment of Wages Act 1991.
