The Workplace Relations Commission ordered Applus Inspection Services Ireland Ltd to pay Tony Groarke €13,545 gross in compensation after finding his sick-pay complaint well founded. The decision was dated 13 October 2023.
Groarke complained that sick pay due under his employer’s scheme had been withheld. The WRC found no evidence the scheme authorised deductions for social welfare payments, and concluded that withholding the sick pay was unlawful. The award is subject to applicable income tax and PRSI deductions.
He withdrew a separate complaint about holiday pay while on sick leave. Issues concerning banked hours and a pay increase had been resolved by the second hearing day.
