The WRC directed a development company to pay a worker €4,730 in unpaid February wages and holiday pay, and a further €3,784 in notice pay. The decision was dated 30 August 2023. The worker said the company had not paid his February 2022 salary, five days of accrued holiday pay or wages for his four-week notice period after he resigned. The company argued that alleged wrongdoing justified withholding the money and that his contract allowed it to withhold notice pay. The adjudication officer found the company had not produced evidence of loss or a compliant basis for deducting the February wages. She also found that five days of carried-over holiday remained payable. On notice pay, she found the company had accepted the notice period and had not exercised its contractual option to pay in lieu. The WRC upheld both complaints and directed payment of €3,784 for February wages and €946 for holiday pay, plus €3,784 for notice pay.
