WRC declines jurisdiction over wages complaint against Srj Contracts Ltd

The Workplace Relations Commission declined jurisdiction over Avtandil Abzhandadze’s complaint that Srj Contracts Ltd unlawfully deducted €3,626.50 from his wages. The WRC decision was dated 28 February 2024. Abzhandadze said he worked as a ceiling fixer for the company from 17 January to 28 February 2022 and earned €1,176 gross a week. He told the hearing he was registered as self-employed, had no employment contract or payslips, and provided his own tools. The company did not attend the hearing. The adjudicator found that the evidence did not establish a separate contractual relationship between Abzhandadze and the company, and that he was not an employee under a contract of service. The WRC therefore found it had no jurisdiction to hear the complaint; the merits were not decided.
