The Workplace Relations Commission found six complaints by Adam Mitchell McGrath against O'Neill & Brennan recruitment and Site Logistics failed. It found it had no jurisdiction to consider his earlier unfair dismissal complaint, which concerned a 2020 termination and was filed more than 12 months later; the merits of that complaint were not decided. McGrath also complained of a later unfair dismissal, family status discrimination, penalisation under corruption legislation, a transfer of undertakings and treatment as a temporary agency worker. The WRC found the later dismissal claim failed because he remained employed after filing it, and that he had not made out a prima facie case of family status discrimination. The WRC found no evidence that McGrath had reported an offence and then been penalised, that a transfer of undertakings had occurred, or that he had been treated less favourably over access to workplace facilities and amenities. The decision was dated 18 April 2023.
