The Workplace Relations Commission found six complaints by Adam Mitchell Mc Grath against P.J. Hegarty & Sons not well founded in a decision dated 12 April 2023. The unfair dismissal complaint failed because the WRC found he had resigned from employment with an employer other than P.J. Hegarty & Sons. His Industrial Relations complaint was repetitious. The Commission also found no prima facie case of family status discrimination and no evidence supporting complaints about alleged penalisation, a transfer of undertaking or agency work treatment. Mc Grath said he had resigned because of bullying and harassment, while the respondent denied unfair dismissal and discrimination. The WRC noted that he had not raised a grievance about his treatment before resigning from his later employment.
