The Workplace Relations Commission found six complaints by Adam Mitchell McGrath against Builders Hoists Ltd failed. The decision was dated 12 April 2023. They concerned constructive unfair dismissal, discrimination on family-status grounds, alleged penalisation, transfer of undertakings and agency-worker treatment. The adjudication officer found McGrath had not shown that his employer’s conduct left him no reasonable alternative but to resign, and he had not raised alleged workplace bullying or harassment with the employer or site operator before resigning. The officer also found no prima facie case of family-status discrimination, no evidence of a transfer of undertaking or qualifying whistleblowing followed by penalisation, and no evidence of less favourable treatment as an agency worker. The second unfair-dismissal claim failed as repetitious.
