The Workplace Relations Commission upheld two complaints by Stephen O’Boyle, awarding him €7,104.33 for an Irish redundancy-payment shortfall and six weeks’ wages in lieu of notice. The decision was dated 26 January 2023.
O’Boyle had been working at the company’s UK site when it entered receivership and made workers redundant without notice in April 2022. He had received statutory redundancy pay under UK law, but said this was €7,104.33 less than his Irish entitlement. The adjudication officer found that his Irish service entitled him to a payment covering his employment with the company, with the UK payment taken into account.
The officer also awarded six weeks’ wages in lieu of notice under the minimum-notice legislation. Roadbridge did not attend the hearing, but the officer found it had been properly notified and accepted O’Boyle’s evidence as credible and persuasive.
