The Workplace Relations Commission upheld Michael Dolan’s complaints against Roadbridge Civil Engineering & Engineering Contracts t/a Roadbridge Ltd. and awarded him €5,875.62 in redundancy pay, along with eight weeks’ wages in lieu of notice. The WRC decision was dated 26 January 2023.

Dolan said he worked for the company from January 2005 and was transferred to the UK on 25 March 2021. After his employment ended on 28 April 2022, he sought the balance of his Irish statutory redundancy entitlement after receiving a UK redundancy payment. He also claimed eight weeks’ pay in lieu of notice.

The WRC found his evidence about his service in Ireland and the UK credible and persuasive. It said Irish law allowed service abroad to count towards redundancy entitlement and required credit for redundancy already paid. The respondent did not attend the hearing. The WRC upheld both complaints and ordered the redundancy payment and eight weeks’ wages under minimum notice legislation.
