WRC dismisses unfair dismissal claim against Parc Aviation on jurisdictional grounds

The Workplace Relations Commission dismissed Krzysztof Knapik’s unfair dismissal claim against Parc Aviation Limited on jurisdictional grounds in a decision dated 21 August 2023. The merits were not decided. Knapik argued Parc Aviation was his employer because it paid his wages and he had employment contracts with the company. Parc Aviation said it engaged him as an agency worker until December 2020, when he moved to direct employment with its client. The adjudicator found that Knapik entered direct employment with the third party from 1 January 2021. Parc Aviation continued processing his salary, but that alone did not establish an employment contract with the company. The WRC said it had no jurisdiction to investigate the claim.
