The WRC found Breda Kelleher’s complaints of penalisation and breach of the Terms of Employment (Information) Act not well founded. The decision was dated 15 March 2023. Her unfair dismissal complaint was withdrawn at the hearing. Kelleher said the employer did not properly accommodate her request not to work with a pharmacist who had bullied her, and that the pharmacist’s earlier transfer to another branch had become a contractual promise. The employer said it had offered separate shifts and that no protected act or change to her contract had been established. The adjudication officer found that Kelleher had not established a protected act or penalisation. The officer also found that the pharmacist’s earlier transfer was not an agreement with Kelleher and created no contract term requiring written notification. The two adjudicated complaints were therefore found not well founded.
