The Workplace Relations Commission upheld Mary O'Donoghue's redundancy complaint against Ultrachem Systems Ltd, directing the company to pay a lump sum calculated using weekly remuneration of €180.33. The decision was dated 6 September 2023. O'Donoghue worked part time for the company from August 1997. She was placed on unpaid layoff in December 2020 and made redundant in December 2021. The officer found her qualifying service and redundancy were not in dispute and set her normal weekly remuneration at €180.33, including €30 she received in cash each week. Two related complaints were found not well founded: a second complaint under the Redundancy Payments Act and one under the Protection of Employment Act. The respondent's managing director did not attend the resumed hearing after attending the first hearing and saying he would provide information about the layoff dates.
