WRC rejects kitchen worker’s redundancy payment claim

The Workplace Relations Commission rejected Shellah Cruise’s redundancy payment claim against Brown Bean Coffee Limited. The decision was dated 3 April 2023. Cruise worked in the kitchen at Loreto School in Dalkey. She said she understood that she would not return after the summer of 2021 and believed she had been made redundant. The school later offered her a direct catering job, which she accepted. The WRC preferred the company’s evidence that Cruise was on temporary lay-off while it waited for pandemic restrictions to be clarified. It found that no redundancy situation had arisen and did not allow her appeal.
