The Workplace Relations Commission had no jurisdiction to investigate Míchéal Ó Lochnáin's complaint that An Roinn Coimirce Sóisialaí Ionad Intreo discriminated against him over Irish-language service. The decision was dated 18 August 2023; the merits were not decided.
Ó Lochnáin also alleged that the department failed to respond to his ES1 form. The department argued that the notification was outside the time limit and disputed the discrimination allegation.
The adjudication officer found that the ES1 was received after the last alleged occurrence and that no unusual circumstances justified waiving the notification requirements. The officer also recorded that interpreter provision after 8 December 2021 was not disputed by the complainant.
