The Workplace Relations Commission found it had no jurisdiction to hear Georgios (George) Katsoulakis’s complaint against Heco Construction Limited under the Payment of Wages Act. In a decision dated 30 March 2023, it said the merits were not decided. Katsoulakis accepted that Heco was not his employer and that its subcontractor, Arkadiusz Lukasiak, was the correct employer. The WRC found Lukasiak had not been notified of the complaint or given an opportunity to respond, and that the naming error could not be corrected. The six-month limit for bringing a complaint against the correct employer had expired by 15 August 2022, so the WRC could not substitute Lukasiak for Heco. Katsoulakis had said he worked 210 hours, received €554 and had been promised €3,000 a month.
WRC rules it cannot hear Georgios Katsoulakis’s wage complaint against Heco Construction
