WRC rejects TUPE complaint against HCL Ireland Information Systems

The Workplace Relations Commission found Owen Phelan’s complaint against Hcl Ireland Information Systems Limited not well founded, ruling that his role had evolved over time but had not changed because of a transfer to HCL. The decision was dated 14 December 2023. Phelan said his Wintel Engineer role was no longer needed after HCL took over a service contract and moved him to a lower-level support team. HCL said his role and contractual terms had not changed. The officer found he remained on the same terms and conditions, and that the complaint under the Transfer of Undertakings Regulations was not well founded.
