The Workplace Relations Commission found that Donegal County Council unfairly dismissed Lisa Dalton and awarded her €10,000. The decision was dated 8 March 2023.
Dalton worked for the council as a beach lifeguard supervisor. The council said her performance was poor and argued that it contributed to her dismissal. Dalton said an unreliable inspection app prevented some uploads, so she kept paper records when it failed.
The adjudicator found that Dalton was dismissed in November 2021, seven months after her probation ended, and was not given the usual fair procedures for a performance dismissal. The adjudicator did not find that she contributed to her dismissal.
The award covered losses from February to August 2022, less her earnings, with a further reduction because her efforts to find work were considered inadequate. The decision said there was no evidence she sought work after August 2022.
