The Workplace Relations Commission found that Bausch Health Ireland Limited t/a Bausch and Lomb correctly calculated public holiday pay for Liam Drennan, a four-shift worker. It found his complaint not well founded. The decision was dated 7 March 2023. Drennan challenged how the company calculated holiday pay, including for shifts that crossed into or out of a public holiday and for holidays when he was not rostered to work. The adjudicator found that excluding overtime when calculating pay for a holiday Drennan did not work complied with the legislation. For a shift spanning a holiday, the payment exceeded the additional day’s pay required by law.
