The WRC found Mark Fleming’s complaint about notice of a change to his working hours not well founded. It ruled four later complaints out of time and recorded that two others were withdrawn. The decision was dated 16 December 2022. Fleming said he had not been notified in writing when asked to work Saturdays. The WRC said the one-month period for written notice had not elapsed before his dismissal on 15 April 2022. The four out-of-time complaints concerned his contract details, an employee handbook, breaks and public holiday entitlements; the merits were not decided. Fleming withdrew a complaint about a pay-related change after accepting there had been no change requiring notification. He also withdrew a wages complaint after accepting he had received his full pay.
