The Workplace Relations Commission found a pay deduction complaint against HSE University Hospital Group Limerick not well founded. Cillian O’Sullivan said he lost about €6,000 a year after moving to a Ward Clerk role.

In a decision dated 28 August 2023, the adjudicator said O’Sullivan’s employment ended on 31 December 2010 with the end of a temporary contract, so he could not have been redeployed to the Ward Clerk role in January 2011. The WRC found no evidence beyond his assertion that he was entitled to a different salary under his contract.

The complaint was made under the Payment of Wages Act. The HSE argued it was out of time; the adjudicator identified the period that could be considered as 9 August 2021 to 8 February 2022, but found the claim unsupported.
