The Workplace Relations Commission found James Rea’s dismissal by Irish Fluid Controls (Chemfeed) Ltd unfair and awarded him €1,000. It also found he contributed very largely to his dismissal. The employer said it dismissed Rea for gross misconduct after discovering missed Legionella tests and serious discrepancies in client work. The adjudicator found the dismissal process moved at breakneck speed and the dismissal was disproportionate, while noting the risks posed by Rea’s failure to complete tests. The WRC decision was dated 6 March 2023. Rea had worked as a sales and services consultant, and said he had been out of work for about six weeks before taking a higher-paid job.
