The Workplace Relations Commission found a dental nurse’s maternity protection complaint against River Lee Dental ltd not well founded in a decision dated 3 October 2023. Elaine Corkery said she was not allowed to return to work after maternity leave and alleged that her terms and conditions were not preserved when the dental practice changed ownership in July 2021. The adjudication officer found that Corkery returned to the same job on an identical contract. Two related complaints under the Transfer of Undertakings Regulations were out of time, so the officer could not decide their substance. Her annual-leave and public-holiday complaints were withdrawn at the hearing.
