The Workplace Relations Commission found that Zsuzsanna Budai was unfairly dismissed from her role at Acd Practice Management Ltd. (Ardrum Clinic) and directed the company to pay her €15,000 compensation. The decision was dated 9 August 2023.
Budai had worked as a receptionist and practice manager at the dental practice since 2013, transferring to the respondent in 2016. She said she was dismissed in January 2022 without a fair process, was short €750 net from her December 2021 salary and did not receive notice pay. The WRC found the dismissal substantively and wholly procedurally unfair, saying she had no opportunity to engage with the employer before it decided to dismiss her. It said compensation was the correct remedy and noted that she mitigated her losses almost immediately.
The WRC also directed the company to pay €815 compensation for the wage complaint and €3,215 in statutory notice pay, equivalent to four weeks’ wages. The decision identified €750 net as the outstanding wages. The company did not attend the hearing, but the WRC was satisfied it had proper notice.
