The Workplace Relations Commission awarded a worker €2,966.31 and €988.77 after finding a local authority failed to give written notice of a change to overtime terms and omitted overtime terms from the worker’s employment statement. A separate wages complaint was not well founded.
In a decision dated 16 May 2024, adjudication officer Moya de Paor found the withdrawal of the worker’s ability to undertake overtime was a material change requiring written notice. The authority had no obligation to provide additional overtime. The wages complaint failed because the worker had not worked overtime during the relevant six-month period, so the claimed payment had not been earned.
