The Workplace Relations Commission found Sar Group had not proved it gave Rafal Morton a written statement of his employment terms and ordered it to pay him €538.07 compensation. The decision was dated 16 March 2023. Morton, a security guard who had worked at the same hospital for 13 years, said he never received a contract or other document setting out his terms. Sar Group said it issued a contract around the 2013 transfer of undertakings, but had no record or receipt showing it was delivered. The Act requires an employer to provide written employment terms within two months of employment starting. The adjudicator found Sar Group could not prove it met that requirement and considered one week’s remuneration an appropriate award.
