Laura Amos was awarded €10,000 after the Workplace Relations Commission found that her dismissal from Cos Clubs was discriminatory on the disability ground. The WRC also found that the employer failed to provide reasonable accommodation.
In a decision dated 25 March 2024, Adjudication Officer Moya de Paor found that Amos had a stress-related condition that met the legal definition of disability. The officer found the employer knew about her condition before dismissing her while she was on certified sick leave.
Amos said she had told the employer about her stress and problems sleeping. Geraldine Quigley, trading as Cos Clubs, denied knowing that Amos had a disability and said her contract ended for reasons including attendance, punctuality and workplace conduct.
The officer found that the employer had not made adequate enquiries into Amos’s condition or considered steps that could have allowed her to remain at work. The €10,000 compensation was for the effects of the discriminatory treatment and dismissal.
