The Workplace Relations Commission ordered Helske Energy Save Limited to pay Cathy Orr €12,846.47 net compensation for unpaid wages after finding the complaint well-founded. The WRC also upheld three other complaints, including unfair dismissal. Its decision was dated 4 October 2022.

Orr worked as the company’s marketing manager. She said wages stopped after she was paid for July 2021 on 17 August, and that she resigned on 16 December. The WRC found €18,281.25 gross in wages due between August and December had not been paid. It also ordered €729.19 gross for personal pension deductions that were not remitted and €1,706.35 gross for the employer’s unpaid pension contributions.

The WRC found that the employer’s failure to pay wages and communicate with Orr made her resignation reasonable and her dismissal unfair. It ordered €6,730.78 for unfair dismissal, equivalent to seven weeks’ gross pay and subject to normal deductions. The respondent did not attend the hearing. The WRC extended the time limit for the pension complaints to 12 months, so it could consider deductions from January 2021 onward; earlier deductions were outside the limit.
