The Workplace Relations Commission found Trevor Guilfoyle’s pay and breaks complaints against Bluestream Waste Water Services were not well founded. The decision was dated 3 October 2022. Guilfoyle said he was promised €19.50 an hour for other work while waiting for a tanker and should have received the €21.50 rate paid to some colleagues. The company said his agreed tanker rate was €18.50 an hour and the colleagues paid €21.50 were more experienced. The adjudication officer accepted that the company had not previously heard of the claimed €19.50 agreement and found those colleagues were more experienced. Guilfoyle’s pay complaint failed. His breaks complaint also failed. The officer noted Guilfoyle had not raised the issue with his supervisor at the time, the timesheets did not support his account, and he had received a toolbox talk about taking breaks. The decision says he withdrew two other complaints.
