A former employee of XS Direct Insurance Brokers Limited has been awarded €60,926.34 after the Workplace Relations Commission found the company failed to pay wages and bonuses properly due to him. The decision, dated 15 August 2022, upheld Thomas Doyle’s complaint under the Payment of Wages Act. The company was in receivership.
Mr Doyle told the adjudication officer that his salary had been cut by €16,616.34 without his agreement, and that he had been promised the shortfall would be paid. He also said two annual bonuses of €22,155 each, for 2019 and 2020, were earned but remained unpaid. The company and its receivers did not attend or make submissions opposing the claim.
The officer found the pay cut and the failure to pay the bonuses were not consented to or otherwise permitted, and that the wages and bonuses were properly payable. The officer said the contravention occurred when the company undertook to pay the money in 2021 but did not. The award is compensation; the decision made no finding about the circumstances in which Mr Doyle’s employment ended.
