The Workplace Relations Commission rejected Katarzyna (Kasia) Czernik’s complaints against RTÉ, finding it had not discriminated against her after a colleague sexually harassed her. The decision was dated 20 September 2023.
Czernik, a part-time multimedia journalist, said a colleague sent her unwanted messages and tried to call her between 18 and 21 June 2021. RTÉ disputed the claims and said it had policies, training, an investigation and support measures in place.
The WRC found that the colleague’s conduct amounted to sexual harassment. It nevertheless decided RTÉ was not liable for discrimination, saying it had taken reasonably practicable steps to prevent harassment and support Czernik, including promptly investigating her complaint. It also rejected her gender discrimination and adverse treatment complaints.
Czernik sought €300,000, but the WRC said compensation did not arise because it found no discrimination by RTÉ. RTÉ’s internal disciplinary process resulted in the colleague’s dismissal.
