The Workplace Relations Commission ordered Tomas Oleksey and Lucia Aruizu Villagomez to pay Montserrat Gordillo €1,200 after finding that the breaks policy at El Grito Mexican Taqueria in Dublin breached working-time law. The decision was dated 13 January 2023. The WRC also directed the respondents to review the policy to ensure future compliance.
Gordillo said she usually worked five-hour shifts and rarely received a break. The adjudication officer found the policy provided a 15-minute break only to employees working more than six hours, although the law requires one for shifts over four and a half hours. The WRC found ten other complaints not well founded, including claims about Sunday premiums, public-holiday pay, roster notice, annual leave and other employment rights.
