The Workplace Relations Commission found Sarah O’Connor’s dismissal by Cas Dental unfair and ordered the company to pay her €12,000 in compensation. The decision was dated 15 December 2023.
O’Connor worked part time as a dental technician. Cas Dental said repeated errors in her work justified dismissal and that its approach was fair. She challenged the process, saying she was not given a fair chance to respond or appeal.
The adjudication officer found serious procedural flaws, including no written dismissal procedure, no right to representation and no appeal process. The officer also found that no reasonable employer would have dismissed her in the circumstances and manner used.
The officer found O’Connor made no contribution to her dismissal, while noting she had not shown every effort to reduce her losses. The decision also upheld her minimum notice complaint and awarded €270, and upheld her written terms complaint, awarding €1,080. The listed duplicate complaints were identified as duplicates.
