The Workplace Relations Commission awarded Bartosz Pawlikowski €14,400 after finding his dismissal by Viva Sure Medical Ltd unfair. The decision, dated 15 December 2023, said the award was equivalent to 16 weeks’ pay and was in addition to statutory redundancy he had already received.

Pawlikowski said he was unfairly selected for redundancy and that the company did not explore suitable alternative roles. The company said the pandemic had sharply reduced its commercial activity and the work available, making his role redundant.

The officer found there had been no consultation before the decision was presented to Pawlikowski as a done deal. He was not given an opportunity to appeal, and suitable alternatives were not properly discussed. The officer also noted his efforts to find engineering work but found he could have investigated other positions to reduce his losses. The €14,400 award reflected that finding.
