The Workplace Relations Commission found that Angela Fitzgerald was unfairly dismissed after her employer failed to consult her meaningfully over redundancy, and awarded her €18,000 in compensation. The decision was dated 19 January 2023.
Fitzgerald said B.R. Marketing Limited decided to make her redundant without proper consultation while recruiting for marketing and sales roles. The company did not attend the hearing. The adjudication officer found the consultation inadequate and that no genuine effort was made to look at alternatives. In assessing compensation, the officer treated six months as a reasonable period to find a suitable role in a buoyant job market. Her separate complaint under the Organisation of Working Time Act was withdrawn.
