Mask dispute at O’Gorman’s Supervalu complaint fails

The Workplace Relations Commission found that Eilis Ronan’s complaint over being asked to wear a mask at O’Gorman’s Supervalu in Carrickmacross was not well founded. The decision, dated 11 August 2022, concerned allegations of disability discrimination and failure to provide reasonable accommodation under the Equal Status Acts.

Ronan said she was exempt from wearing a mask and that wearing one caused her distress. The shop owner said masks were obligatory and offered to do her shopping, but she declined and left. The adjudication officer found Ronan had provided no evidence establishing a disability and had not shown the respondent knew of one at the time. She therefore did not establish that she was treated less favourably because of a disability or denied reasonable accommodation.
