The Workplace Relations Commission found four complaints by managing solicitor Teresa Tyler against the Legal Aid Board not well founded. The decision, dated 18 January 2023, concerned two salary recoupments and allegations of family-status and disability discrimination.
Tyler challenged deductions of €2,360 and €347, which the Board said repaid overpayments following a period of temporary rehabilitative remuneration and a delayed increment. The adjudicator found the deductions were repayments covered by the Payment of Wages Act. Tyler also alleged discrimination in connection with the recoupments; the adjudicator found she had not established a prima facie case or proved discrimination on either ground.
Tyler left the hearing after her request for a postponement was refused, and the case proceeded in her absence. The adjudicator recorded that she understood the case would continue, but made substantive findings on all four complaints: the merits were decided, and each was found not well founded.
